According to the Las Vegas Review Journal UFC superstar Alistair Overeem has been charged with misdemeanor battery stemming from an altercation at Wynn Las Vegas over New Year's weekend. That would have been the period of time when Overeem was in town for his fight with Brock Lesnar at UFC 141. Overeem won that fight by first round TKO.
It appears that Overeem shoved a woman in the face and, while not arrested, was given a citation. He is scheduled to appear in court on February 21 and faces up to six months in a detention center and a $1,000 fine.
The UFC has not yet commented on the situation and I don't expect them to until after the court date passes and we see exactly what comes out of it.
I seriously doubt he gets 6 months and I don't have the knowledge to really understand how Overeem's nationality affects things.
I will say that, while I'm sure there's more to the story, I'd like to think that there is a way for a 6'5" 260+ pound professional fighter to handle a situation involving a woman that doesn't involve shoving or hitting. So, hopefully this turns out to be nothing.

I call BS
Im betting the club was cramped, the girl was drunk and the situation was no way near as serious

No where near as serious as a misdemeanor citation? That is almost as non-serious as it gets

One person alleged that Chael killed 3 hookers in the mid 90’s, while another person alleged that Chael killed 2 other hookers. 2 + 3 = 5 hookers killed by Sonnen.

Immigration consequences
Misdemeanor battery is a “crime involving moral turpitude” under immigration law, even if he receives no time, and even if it’s just a misdemeanor, as long as it requires an intent to inflict bodily harm, and not just an intent to touch or recklessly inflict bodily harm. I’m not familiar with Nevada (or in this case, probably Las Vegas) law, but a quick read of the statute looks like it requires intent.
There is something called the petty offense exception under immigration law, where as long as the maximum possible sentence is one year or less, and Reem actually gets less than 6 months, it won’t prevent him from entering the U.S., at least in theory. However, U.S. consulates have basically unfettered discretion in issuing visas, and I’m guessing Reem has what’s called a P1A performers visa, so if they want to use it to deny a visa, they could.
That being said, this sounds like a stupid case, and as long is it’s a 1st offense, no way does Reem actually plead guilty to the charge. His mega-priced attorney will surely get the charge lowered or dropped, in which case, no problem.
galathrax - January 31, 2012
wow…thanks for the info
Brent Brookhouse - January 31, 2012
It’s been a while since immigration law, but that sounds about right. Also, while journalists love to throw around the theoretical maximum penalty for any given crime, more than likely this is a $100 disturbing the peace ticket and is nothing to worry about.
toxic - January 31, 2012
Did a little more research...
Procrastinating, anyone?
Nevada battery is actually not a moral turpitude crime. Force includes a broad array of conduct, not all of which is violent. So no problem.
But as toxic says, no way does he actually plea to this or get convicted of it. To be honest, I can’t think of a reason why charges got filed in the first place. No actual injury, at a club, where everyone is drunk? Give me a break.
galathrax - January 31, 2012
you're (presumably) a lawyer and can't figure out why charges got filed against a famous person?
isn’t money usually the answer?
(rec for the analysis in your initial post)
mollcutpurse - January 31, 2012
Touche
galathrax - January 31, 2012
Injury doesn't make a difference
It’s not a civil suit. Its a criminal charge. The majority rule on battery in the criminal context is an unwanted intentional offensive touching = battery. There is no requirement that the defendant inflict injury, or intend to inflict injury. He only needs to intend to carry out the uninvited offensive/ harmful touching. Now, I say that’s the majority rule. Nevada may require injury as an element of criminal battery, but I highly doubt it. So if I’m the prosecutor, and I’m reading the police report, I’m looking to see if all the elements of the offense are present, and I might take a look at the impact it had on the victim. And I don’t mean in terms of physical injury, but maybe that would be considered w/in the scope of the overall impact.
miked612 - January 31, 2012
Touching a person isn't battery
TheFilt - January 31, 2012

galathrax - January 31, 2012
Unwanted offensive touching, with no intent to injure or harm
rarely leads to a conviction.

Looking for a job with the UFC
I think they should bring the immigration aspect of fighter visas (and of course, fighters coaches, families, etc) in-house, which I will gladly do for the low-low price of cageside tickets to every UFC and an average salary. Becoming Joe Silva’s right hand man would be another sacrifice I’d be willing to make.
There used to be issues all the time with fighters failing to get visas, for example Mark Hunt and Yushin Okami come to mind. But I haven’t heard anything lately.
I tried to ask Dana for a job at UFC 82 in Columbus, but I chickened out and just shook his hand instead. Maybe if it ever gets regulated in New York, I’ll give it another go.

It did seem like she was bothered by his antics.
She was cool with him hitting her, and doing the chokes, because it was planned and they were just playing around a bit. But When he ambushed her like that, it was pretty clear that she wasn’t prepared for some giant dude to grab her and toss her to the ground.

Perfectly sober. Well, except caffeine and nicotine. The whole point of the segment was to rough her up and make her feel uncomfortable, almost a Jackass type deal. I honestly don’t care what she may or may not have felt during those few seconds you’re harping over. She must have been aware something like that could happen when she came up with this concept.
Horselover Fat - January 31, 2012
It was an involuntary reaction.
People agree to something, and their mind says “Go!,” but instinct says “Fuck this. I didn’t sign for this shit!”
Unabomberman - January 31, 2012
A video was posted below.
She was laughing and smiling when Overeem was hitting her(lightly) and even when he put her in the chokes. But when he grabs from behind, you can tell she is struggling and isn’t having fun anymore. And then when she is on the ground, she sits up to finish the interview(or w/e it was) and you can see that she is a little shaken up about what just happened. It seemed like it was planned and she didn’t enjoy it.
That being said, I don’t believe Overeem was being malicious. I think he was just trying to be funny and forgot that he was a 250 pound athlete/trained fighter and she might not like being ragdolled by somebody she was trusting not to hurt her.
Warbreezy - January 31, 2012
True
At a certain point, its natural to be scared even if there’s no real danger.
Like a roller coaster.
TheFilt - January 31, 2012
I think most peole would be a little scared if they were playing with an MMA fighter
Even though they know that these, especially the HWs, are generally the nicest people on earth, it’s still a scary prospect. It would also have to be terribly fun to have your favorite fighter hit you/submit you/throw you around etc, without being in any real danger. I think she agreed to all of those things, and had a good time of it.
However, I don’t think they planned on him grabbing her from behind, putting his hand over her nose and mouth while she struggled, and then tossing her on her face. That is pretty clearly shown by her expressions during and directly after it all went down.
Warbreezy - January 31, 2012
Yeah well, again, she brought it on herself. See my reply to Hardy’s above.

menckenstein - January 31, 2012
A friend of mine was charged with misdemeanor battery after breaking up 2 drunk girls fighting at a burger king at 2am. After they were separated, the girls (who were friends) decided to apologize to each other then told the arriving police that my buddy had joined in on the fracas and attacked the one he pulled off.
The charges magically disappeared after burger king coughed up the security tapes.

My charges were dropped once my attorney showed the photos of the scratches all over the boy’s neck/shoulders scalp, from her trying to scale him and the swabs the cops took from under the chick’s nails. I think she ended up paying some kind of fine and had some probation because he was a minor.
