Nevada State Athletic Commission (NSAC) Executive Director Keith Kizer went on Sirius Radio on Friday and answered questions relating to UFC star Nick Diaz' positive test results for marijuana after UFC 143. Kizer, The NSAC has previously suspended Diaz for the same offense following his bout with Takanori Gomi at Pride 33 in 2007.
Here's what Kizer had to say on Posterous:
"The complaints have been mailed to him. He'll receive the complaint by mail and he'll have 20 days upon receipt to file an answer.
"With the complaint, those are just allegations at this time. There's been no finding against him. He'll have ample opportunity to respond to the complaint and then we'd put it on for a hearing at a time that works for him as well as the Attorney General's office.

Probably April based on past disciplinary complaints and at that time, there'll be a hearing before the full commission and then they make a decision at that time and if they found the athlete guilty, they'd then impose whatever discipline they felt was appropriate."
Diaz lost a unanimous decision to Carlos Condit at UFC 143. At one point it appeared that the UFC had secured agreements from both fighters for an immediate rematch. Diaz' test failure immediately scotched that possibility.

He will help us legalize pot in this god forsaken country. Free all non-violent offenders from jail with the right president. I can’t believe people bitching about other countries and their freedoms when we consider pot a performance enhancing drug in this country. Are there a lot of (occasionally annoying) middle class white dudes out there who want it legalized just so they can get high and express their love of Bob Marley far and wide? Sure.
But take a look at the statistics on race and arrests, prosecution, punishment (treatment vs prison), and length of incarceration. At every step of the way being white significantly improves the odds that you will see lesser, or no, consequences from your actions.
The system is racist and it disproportionately targets and disenfranchises the poor. All this to stop using a plant which is demonstrably and categorically safer than both tobacco and alcohol, and has no empirically based justification for being illegal.
The origins of cannabis prohibition are quite disgusting, actually, and I doubt most people realize just who they’re throwing their hat in with when they support prohibition. Here’s one of many such quotes from (IIRC), the sole “expert” who testified at the senate hearings to make cannabis illegal:

There are some genuine civil rights issues at play, annoying fanboys or not ;)

All Diaz might need to do is produce documentation that his marijuana use is medical. Hell, he could present any licensed doctor as a witness to provide evidence that marijuana doesn’t harm him as a fighter, nor provide enhancing benefits. Hmm.

If he wanted to excuse his usage as medically necessary, he should have applied for a TUE.
He may have some semblance of defense by arguing that he wasn’t under the influence and he’s legally allowed to use it in the state where he’s training. That’s going to be hard to prove, but it might get his suspension reduced.

But he will still get a slap on the wrist for this, probably 6 mo. Suspension.
He could still end up with a rematch if the story stays hot enough to sell PPVs in the fall.

That could happen, but that isn’t a guarantee. A doctor saying you can use a drug doesn’t mean the commission will. Not all drugs on the list are “performance enhancing.” He probably would have had a better chance if he would have tried that approach before the fight.

Most people call it spice and its sold everywhere in smoke shops. Its sprayed with synthetic canniboids that mimic the effects of marijuana. However they add a lot of other harmful chemicals than can cause adverse reactions in individuals.

Theres an argument like that for a lot of drugs such as MDMA. (xtc) They started government started cracking down about a year ago on the chemicals used for making it. Since the chemists can’t get those materials they resort to replacing them with other more harmful chemicals to make MDMA like drugs. Now streets are flooded with nasty stimulants and research chemicals being sold as ecstacy. All the government did was cause more harm not less.
